Smart Motorhome and Caravan Sales Ltd are New Zealand’s biggest importer of European motorhomes, and are the exclusive distributor in New Zealand for Bürstner, Carado and HYMER brands, which have a reputation for being world leaders in recreational vehicles (RV).
When you (the Purchaser) purchase your new or used motorhome from us, we supply you with a “Rest Easy” warranty so that you can purchase with confidence and enjoy a worry-free ownership experience with us.
Our “Rest Easy” warranty applies to all our new or used RVs and covers mechanical issues as well as the fit-out of your RV.
You should always contact us in the first instance when a warranty issue arises.
Our liability in respect of any breach of an applicable warranty in this Appendix will not exceed the Purchase Price paid under this Agreement.
1.1.1. Fiat: 2 year warranty on RV chassis (subject to servicing at 12 months or 48,000kms by an approved Fiat agent).
1.1.2. Mercedes: 2 year warranty or 200,000kms on RV chassis (subject to servicing at 12 months or 48,000kms by an approved Mercedes agent).
1.1.3. Burstner, Carado or HYMER: 2 year warranty on motorhome fit-out.
1.1.4. Water Tightness:
1.1.5. Burstner and Carado: 6 month warranty on house batteries.
21.1 A 3 month warranty on RV chassis and motorhome fit-out.
21.2 The remaining balance on Burstner, Carado or HYMER 5 year warranty on water tightness (subject to annual water tightness tests by us or one of our approved agents).
The warranty does not cover the following:
22.1 Normal regular service components, including but not limited to friction items such as brake shoes, pads and clutch discs.
22.2 Any Vehicle failure whilst the Vehicle is being used as a sublet or commercially (i.e. as a taxi, courier vehicle, shuttle, or any vehicle used for hire or reward.)
22.3 Any aftermarket enhancements, electrical or mechanical parts installed after the date of this Agreement, unless those items were installed by us, and any failure arising from these items.
22.4 Failure to adequately care for and maintain the Vehicle as described in the relevant manufacturer’s owner’s manual.
22.5 Repairs to or replacement of components required as a result of the use of the Vehicle for anything other than recreational purposes.
22.6 Repairs to or replacement of components required as a result of the use of incorrect fuel, fluids, or fuel or fluid into water systems.
22.7 Repairs to or replacement of components required as a result of the vehicle being involved in an accident.
22.8 Repairs to or replacement of components required as a result of wilful damage, neglect or abuse of the Vehicle.
22.9 Repairs to or replacement of components required as a result of failure to take reasonable care of the Vehicle including following a failure of the Vehicle.
22.10 Repairs to or replacement of components caused by faulty workmanship through insurance repair or repair completed by anyone other than us.
22.11 Repairs to or replacement of components required as a result of external forces including, without limitation, contamination, water damage, fire, natural disaster, atmospheric conditions, rodent damage, stone chipping, corrosion, rust or the perishing of any part of the Vehicle.
22.12 Normal wear and tear, including interior surfaces, upholstery or paint.
22.13 Damage or failures resulting from theft or fire.

This policy is applicable to parts purchases only.
We will meet our obligations under the Consumer Guarantees Act 1993. Where the products are faulty or damaged due to manufacturing faults* we will either: (a) replace the product; or (b) repair the product; or (c) give you a full refund.
*Manufacturing faults do not include normal wear and tear and damage caused by accidental or non-accidental damage.
In the unlikely event that a motorhome you have purchased from SmartRV experiences faults, we are committed to meeting our obligations under the New Zealand Consumer Guarantees Act 1993 (CGA).
The New Zealand Consumer Guarantees Act 1993 is legislation that outlines the guarantees and rights of both the seller and consumer for products and services sold.

If you are purchasing a motorhome for the purpose of business, then the provisions of the Consumer Guarantees Act 1993 (to the extent permissible by law) shall not apply as defined in sections 2 and 43 of the Act. Any warranty is restricted to that warranty provided by SmartRV and the manufacturer of the vehicle.

We will always aim to resolve disputes directly with you (the owner), however if you are unable to obtain a response to your satisfaction we ask that you notify SmartRV directly before any further action is taken.
The Motor Vehicle Sales Act 2003 provides that the Motor Vehicle Disputes Tribunal can hear and determine applications or claims made against a motor vehicle trader under subpart 3 of Part 2 or Part 3 of the Contract and Commercial Law Act 2017, the Fair Trading Act 1986 and the Consumer Guarantees Act 1993. The Tribunal can hear claims of up to $100,000.
